What this means for EU users

Toobit is a newer venue — secondary sources place its launch in 2022 and its incorporation in the Cayman Islands, and it publishes no HQ or founding date.

Its terms assign EU/EEA users to a Polish counterparty, Elyndret Sp. z o.o., under a Polish VASP registration, which is a pre-MiCA anti-money-laundering listing rather than a MiCA CASP authorization.

That distinction bites in 2026: Poland’s law empowering its regulator (KNF) to grant MiCA licences was vetoed twice by the Polish president (December 2025 and February 2026), so no Polish entity could hold a genuine Polish MiCA licence at the transition deadline.

Toobit keeps onboarding EU users on offshore/VASP terms and is not in the ESMA register. No hack of exchange funds is reported, though Toobit’s official X account was compromised via phishing in August 2025 (it says no funds were affected).
